TERMS AND CONDITIONS FOR BOOKING SERVICES AT GLOKIEM I MIECZEM „Paweł Tuła”

The provisions of these Regulations (hereinafter referred to as the „Regulations”) specify the terms and conditions for making reservations by natural and legal persons (hereinafter referred to as the ”Client”), methods and deadlines for payment for reservations, reservation confirmations, and complaint procedures at PAWEŁ TUŁA, managed by Paweł Tuła, conducting business under Paweł Tuła ul. I. MAKING A RESERVATION

Before making a telephone or email reservation, please ask
to the availability of the service at the chosen date.
An availability request involves specifying the date of interest, the type of service, and the quantity.

Bookings can be made:
– by telephone, by calling the phone number indicated on the website,
– by means of electronic mail, by sending an email to the email address provided on the website, or
– using the online booking system, available on, among others, the website www.glokiemimieczem.pl
When making a reservation, please provide the following information:
– terms of service
– number of people
– contact details (phone number or email address)
– the desire to receive a VAT invoice and to provide the data necessary for its issuance.
Every reservation made by telephone or email requires confirmation by the Service Provider to be effective.
By booking confirmation, it shall be understood:
– the Service Provider sending an email, or
– information provided by telephone, indicating that a reservation has been made.

The client undertakes to pay the remaining amount for the service after its completion.
In the absence of a deposit payment within the timeframe specified in point I, paragraph 7 of these regulations, the reservation shall be considered cancelled.

II. CHANGING A RESERVATION AND ITS DEADLINE, AND CANCELLING A RESERVATION

Changes to bookings, rescheduling, and cancellations can be made
by telephone or by e-mail.
A change to a reservation, as well as a change to the reservation date, is a discretionary decision in each case.

A change to the booking date can only occur if the service provider has availability on the new date proposed by the Client.
A change to a reservation made more than 7 days before the originally scheduled service date is not subject to an additional fee.
If the reservation is rescheduled to a date less than 7 days before the original scheduled service date, the Service Provider is entitled to charge a booking change fee of PLN 100.
If the Service Provider does not consent to a change to the booking or its date, the Client is still entitled to use the service in accordance with the booking made and paid for.
In the event of a booking cancellation by the Customer, the deposit is non-refundable.

III. COMPLAINTS

The client is entitled to lodge a complaint immediately after the cause entitling them to do so arises.
A complaint shall be understood as any application, grievance, or objection addressed to the Service Provider.
The complaint should be submitted in writing and include the claimant's full name, contact details, and booking details (service), as well as describe the situation being complained about and specify the claimant's request in detail.
The complaint will be considered by the Service Provider without undue delay, no later than within 14 days of its receipt.
The Service Provider shall inform the Customer of its decision regarding the submitted complaint in writing or via e-mail to the e-mail address provided in the complaint.

IV. FINAL PROVISIONS

The Service Provider shall not be liable for being unable to provide the service to the Client in accordance with the concluded agreement in the event of force majeure, i.e. extraordinary circumstances beyond the control of either party, natural disasters, strikes, acts of war, or other exceptional situations.
The applicable law for any disputes arising between the Client and the Service Provider shall be Polish law.
In the event of a dispute, the competent court for its resolution shall be the court of the Service Provider's registered office.
Any changes to the Terms and Conditions will be made by publishing the new content of the Terms and Conditions on the website www.glokiemimieczem.pl.
The Service Provider reserves the right to unilaterally amend the provisions of these Regulations without needing to provide a reason for the amendment.

V. PERSONAL DATA PROTECTION

The controller of personal data provided by the Client during the booking process is Paweł Tuła, operating under the company PAWEŁ TUŁA at ul. Onufrego Zagłoby 41, 54-514 Wrocław, NIP: 886-203-08-42, REGON: 383689520.
The Customer's personal data will be processed for the purpose of making and fulfilling bookings based on the necessity of performing the contract (Art. 6(1)(b) of the Regulation of the European Parliament and of the Council (EU) No 2016/679 of 27 April 2016 „GDPR”) and, if explicit consent is given, also for marketing purposes, i.e. such as informing about new promotions and offers, based on the consent given by the Customer (Art. 6(1)(a) of the GDPR).
Providing personal data is voluntary, although necessary for making a reservation or receiving marketing information.
The data will be processed for one year from the time the reservation is made, or, if consent is given, until consent is withdrawn, an objection is raised, or the data is deleted.
The processed data will not be transferred outside the European Economic Area or to an international organisation, nor will it be subject to automated decision-making, including profiling.
The client has the right to access their personal data, rectify it, erase it, or restrict its processing, as well as the right to object to processing and the right to data portability.
Furthermore, the Client has the right to lodge a complaint with the supervisory authority, i.e. the President of the Personal Data Protection Office, ul. Stawki 2, 00-193 Warsaw.
At any time, the Client may withdraw the consent granted, without affecting the lawfulness of processing based on consent before its withdrawal.
Data may be shared with the following entities: public authorities in connection with an existing legal obligation, IT companies – reservation system operators.
