Our aim is to provide you with ongoing and proper information regarding operations carried out by us on personal data. In this Privacy Policy, we will endeavour to present in detail all situations in which we collect information about you. We will indicate the purpose and legal basis for processing, the scope of data collected, and we will also inform you about the period for which this personal data will be processed by us. Additionally, we will attempt to indicate and discuss all rights that you have in connection with the processing of your personal data by us. Please remember that the processing of your data always takes place with respect for applicable laws, both national and those in force within the European Union (including GDPR).

PERSONAL DATA AND THEIR PROCESSING – DEFINITIONS

Personal data means any information relating to an identified or identifiable natural person. Personal data will therefore include information that allows us to determine the identity of a specific person, as well as information that does not allow for their immediate identification but, with a certain expenditure of cost, time, and effort, especially when using easily accessible and publicly available sources, is sufficient to establish it. Therefore, personal data does not include individual pieces of information of a highly general nature, e.g., name, country of residence, salary amount. However, this information will constitute personal data when it is combined with other additional information that can consequently be attributed to a specific person (e.g., name, PESEL number, etc.). On the other hand, the term "processing of personal data" covers practically all possible operations performed on personal data, regardless of whether they are carried out automatically or not. Therefore, processing of personal data will include, among other things, collection, storage, recording, organisation, modification, consultation, use, disclosure, restriction, erasure, or destruction of data.

Who is the administrator of your data

The data controller described in this Privacy Policy is Paweł Tuła, conducting business under the name PAWEŁ TUŁA, ul. Onufrego Zagłoby 41, 54-514 Wrocław.

HOW WE PROTECT YOUR DATA

In connection with our business activities, we collect and process your personal data at all times based on applicable laws, including in particular the EU General Data Protection Regulation – GDPR. We ensure transparency in the processing of your personal data, including by informing you about data processing at the time of collection, including the purpose and legal basis for processing (e.g., when making a reservation). We also emphasise that data is collected only to the extent necessary to achieve the stated purpose and processed only for the period for which it is necessary. Only persons authorised by us have access to your data, and only to the extent necessary for the tasks they perform. Additionally, we have implemented appropriate technical and organisational measures to ensure the security and confidentiality of your data. However, should a breach of your personal data protection occur despite our security measures (e.g., a data „leak” or loss), we will inform the relevant authorities and you in accordance with the regulations.

ON WHAT BASIS DO WE PROCESS YOUR DATA

The most common basis for us processing your personal data is the premise of fulfilling a contract or actions taken by you before entering into a contract. In other words, we process your data to the necessary extent because, for example, you have booked a service using a booking system. Occasionally, we process your personal data because it is required by applicable laws. For example, data contained in sales documents (e.g., VAT invoice) is processed by us because a legal provision requires sales to be documented in a specific way, specifies the scope of data that must be included in such a document, and defines the period for which we are obliged to store this data. There may also be situations where we process or will process your personal data based on your consent. Remember that we will always explicitly ask for your consent. This request for consent will be presented in a way that allows it to be distinguished from other matters, in an understandable and easily accessible format, using clear and simple language.

For what purpose and under what circumstances do we share your data

As a general rule, we do not share your personal data with third parties who could use it for their own purposes, without your explicit consent. The exception to the above rule is sharing some of your personal data with authorised (i) state authorities (including government offices) acting on the basis of and within the scope of applicable law, and (ii) banks, which receive data from us related to financial transactions carried out. We share your personal data with third parties who perform specific services for us. Among such service providers, we can particularly distinguish: technical operators, including IT companies that manage, host, and service the technical and IT infrastructure for us. However, we wish to assure you that these service providers have been carefully selected by us and are obliged, by virtue of appropriate agreements, to use the data entrusted to them solely according to our guidelines and for a specifically defined purpose. The level of personal data protection outside the European Economic Area differs significantly from that provided by European law. For this reason, we will transfer your data outside the EEA only when necessary, and with an appropriate level of protection, primarily through: (i) cooperation with entities processing personal data in countries for which an appropriate decision of the European Commission has been issued concerning the establishment of an adequate level of personal data protection, (ii) the use of standard contractual clauses issued by the European Commission, (iii) the use of binding corporate rules approved by the competent supervisory authority, (iv) in the case of data transfer to the USA – cooperation with entities participating in the Privacy Shield programme approved by a decision of the European Commission.

WHAT RIGHTS YOU HAVE IN RELATION TO OUR PROCESSING OF YOUR DATA

We make every effort to fulfil your GDPR rights, namely: the right to withdraw consent, the right of access to personal data, the right to rectification of data, the right to erasure of data, the right to restrict processing, the right to data portability, the right to object, and the right not to be subject to decisions based solely on automated processing.

Right to withdraw consent
You have the right to withdraw any consent you have given us for the processing of your personal data. Withdrawal of consent takes effect from the moment of withdrawal, i.e. it does not affect processing carried out by us lawfully before its withdrawal. Withdrawal of consent should not have any consequences; however, it may prevent further use of services we provided on the basis of the given consent.

Right of access to data
You have the right to obtain confirmation from us as to whether we are processing your personal data, and if so, you have the right to:
obtain information about the purposes of processing, categories of personal data processed, recipients or categories of recipients of this data, the planned period of storage of your data or the criteria for determining this period, your rights under GDPR and the right to lodge a complaint with a supervisory authority, the source of this data, automated decision-making, including profiling, and the safeguards applied in connection with the transfer of this data outside the European Union;
obtain access to your personal data. Access to data should be understood, for example, as obtaining a copy of all your personal data processed by us.

Right to rectification of data
You have the right to have your personal data rectified and supplemented.

In addition, we would like to inform you that we will endeavour to rectify any inaccuracies or errors in the personal data we process about you and to complete it if it proves to be incomplete. Right to erasure („right to be forgotten”) You have the right to request that we erase all or some of your personal data, and we are obliged to do so in any of the following circumstances: your personal data is no longer necessary for the purposes for which it was collected or processed. Such purposes include, amongst others, storing data for the period during which you may make a claim against us, or for the period during which there is a legal obligation arising directly from the law regarding the storage of your data related to financial records, i.e. including invoices or receipts. As a general rule, we process your personal data for a period of 6 years from the date of collection. Only after this period may the data be deleted by us or at your request. If you believe that the purpose for processing your data no longer applies, you may request its deletion. You have withdrawn your previously given consent, to the extent that personal data was processed on the basis of that consent. In most cases, we process your personal data on the basis of the contract between us. However, if we happen to process your data on the basis of your consent, you may also request the deletion of the data you provided when giving that consent once you have withdrawn it. You have objected to the use of your personal data for marketing purposes. You may lodge an objection at any time. This is discussed in more detail under the right to object. If you have lodged an objection, you may also request the erasure of your data. Your personal data is being processed unlawfully. Compliance with data protection principles is our top priority. However, if you believe that we are processing your personal data unlawfully, you may always request the erasure of such data, specifying which provisions we have breached or how our processing of your personal data is unlawful. This will be crucial information for us, enabling us to correct any errors in the future. Right to restriction of processing You have the right to request the restriction of the processing of your personal data. If you make such a request, we will not be able to carry out any operations on your personal data, except for storing it. You may request restriction of processing in the following cases: where you contest the accuracy of your personal data – in which case we will restrict processing for the time necessary to verify the accuracy of your data. where the processing of your data is unlawful – and you request restriction of processing instead of erasure. where your personal data is no longer necessary for the purposes for which we collected or used it, but you need it to establish, exercise or defend legal claims; where you have objected to the use of your data on the basis of our legitimate interest – in which case the restriction applies for the time needed to assess whether, in view of your particular situation, the protection of your interests, rights and freedoms outweighs the interests we pursue by processing your personal data. Right to data portability You have the right to receive from us the personal data you have provided to us and which we process in our IT systems, and then to transmit it to another data controller of your choice. You also have the right to request that we transmit your personal data directly to such another controller, provided this is technically feasible. We will send your personal data in the form of a file saved in one of the commonly used machine-readable formats, such as csv or xml. The use of such a format should enable the data to be transferred to another data controller. Right to object to the use of data You have the right at any time to object to the use of your personal data for purposes related to the direct marketing of our products and services. An objection does not result in the deletion of the data, but merely in us ceasing to use it for marketing purposes. You may also object at any time – on grounds relating to your particular situation – to the processing of personal data carried out on the basis of our legitimate interest. Any objection in this regard should be accompanied by a statement of reasons. Right not to be subject to decisions based solely on automated processingYou also have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you. The legal effects referred to above should be understood as the creation, modification or termination of a legal relationship, e.g. a contract. Such profiling may therefore include, for example, the granting or refusal of a loan, the application of enhanced security measures, the automatic disconnection of a telephone number as a result of failure to pay a telephone bill on time, etc. We would like to inform you that, with regard to your personal data, we do not make decisions based solely on automated processing, including profiling; consequently, we see no grounds for you to make such a request. However, if you disagree with our view, you are always free to make such a request.

By what time will we fulfil your request

If you make one of the above requests to us by telephone or by contacting us at the email address provided below, we will inform you immediately whether your request has been granted or refused, but no later than one month from the date we receive your request. If it transpires that, due to the complex nature of your request or the number of requests, we are unable to fulfil your request within one month, we will fulfil it within a further two months, having previously informed you of the intended extension of the deadline.

PRIVACY POLICY CHANGE

This Privacy Policy is subject to systematic review and its content may be changed, particularly in the event of changes in legislation, new guidelines from authorities responsible for supervising personal data protection processes, or the emergence of industry codes of good practice.

IN WHICH SITUATIONS DO WE PROCESS YOUR PERSONAL DATA MAKING A SERVICE RESERVATION

If you use the booking form, or make a booking by telephone or e-mail, you will be asked to provide certain details, in particular your name, e-mail address and contact telephone number. Please remember that you provide this data voluntarily, although failure to provide certain data may result in the inability to book the service. The data you provide will be processed by us for one year from the time of booking.

DATA COLLECTION IN OTHER CASES

In connection with our business activities, we may also collect your personal data in other cases – for example, by building and using lasting mutual business relationships (networking) during business meetings and at industry events. The legal basis for processing in this case is the legitimate interest of the Controller (Article 6(1)(f) GDPR), consisting in building a network of contacts in connection with business activities. Personal data collected in such cases are processed solely for the purpose for which they were collected, and the Controller ensures their adequate protection.

Polityka prywatności WPROWADZENIE Pragniemy Cię zapewnić, że należytą ochronę danych osobowych traktujemy jako jeden z najważniejszych aspektów prowadzonej działalności gospodarczej.
